Bagulia Terms of Sale

Welcome to Bagulia, purveyors of luxury handmade leather bags. By placing an order through our website, you agree to the following Terms of Sale. Please read them carefully before completing your purchase. If you do not agree with any part of these terms, please refrain from placing an order.

By completing a purchase on bagulia.com, you confirm that you are at least 18 years of age, or that you have obtained parental or guardian consent to make a purchase. You also confirm that you have read, understood, and agreed to these Terms of Sale, our Refund & Returns Policy, and our Privacy Policy.


1. Product Information

Artisanal Craftsmanship: Each Bagulia handbag is meticulously handcrafted by skilled artisans. As a result, slight variations in color, texture, and finish may occur between individual pieces. These natural variations are not considered defects — they are a hallmark of genuine handmade craftsmanship and enhance the unique character of your piece.

Product Descriptions: While we make every effort to display our products as accurately as possible, we cannot guarantee that your screen's display of colors will be completely accurate. Product images are for illustrative purposes only.


2. Pricing and Payments

Currency: All prices are listed in Euros (€) and include applicable taxes where required by law.

Pricing Errors: In the event of a pricing error on our website, Bagulia reserves the right to cancel the order and issue a full refund. We are not obligated to fulfill orders placed at incorrect or mispriced amounts. You will be notified promptly if this occurs.

Accepted Payment Methods: We accept payments via Shopify Payments, Stripe, and PayPal. By providing your payment details, you confirm that:

  • You are fully authorized to use the chosen payment method
  • The payment information provided is accurate and complete
  • You will not initiate fraudulent chargebacks or disputes

Failed Payments: If your payment cannot be processed, your order will not be confirmed. Bagulia is not responsible for any delays or losses resulting from failed payment transactions.

Payment Security: All transactions are encrypted and processed securely. Bagulia does not store your full payment details on our servers.


3. Orders

Order Confirmation: Upon placing an order, you will receive an automated email confirmation. Please note that this confirmation is an acknowledgment of your order — it does not constitute acceptance. Acceptance of your order occurs only when we dispatch the product and send you a shipping confirmation.

Right to Refuse or Cancel Orders: Bagulia reserves the right to refuse or cancel any order at our sole discretion, for reasons including but not limited to:

  • Product unavailability or stock discrepancies
  • Errors in product description or pricing
  • Suspected fraudulent activity flagged by our fraud detection system
  • Failure to meet the eligibility requirements outlined in these Terms

In the event of cancellation, you will receive a full refund to your original payment method within 7–10 business days.

Order Amendments: Once an order has been placed, we cannot guarantee that amendments can be made. Please contact us immediately at support@bagulia.com if you need to make changes, and we will do our best to assist before dispatch.


4. Shipping and Delivery

Complimentary Shipping: We offer complimentary standard shipping (6–14 business days) on all orders worldwide.

Delivery Timeframes: All delivery timeframes are estimates only and are not guaranteed. Bagulia is not liable for delays caused by carriers, customs processing, or circumstances beyond our control.

Customs and Duties: International orders may be subject to customs duties, import taxes, and fees imposed by the destination country. These charges are the sole responsibility of the recipient. Bagulia has no control over these charges and cannot predict their amount. We recommend contacting your local customs office for further information before placing your order.

Refused Delivery Due to Customs: If a customer refuses delivery due to customs charges or any other reason, the order will not be eligible for a refund until the item is returned to us in its original, unused condition. Any return shipping costs, customs fees, or handling charges incurred will be deducted from the refund amount.

Lost or Damaged in Transit: If your order is lost or arrives damaged, please contact us within 48 hours of the expected or actual delivery date with photographic evidence where applicable. We will work with the carrier to resolve the issue as quickly as possible.


5. Returns and Exchanges

Return Policy: We accept returns within 14 days of the confirmed delivery date, provided the following conditions are met:

  • The item is unused, unworn, and in its original condition
  • All original tags are attached
  • The item is in its original packaging
  • Proof of purchase is provided

Returns that do not meet these conditions will not be accepted and will be returned to the sender at their expense.

How to Initiate a Return: To begin the return process, please contact us at support@bagulia.com within 14 days of delivery. Include your order number, reason for return, and supporting photos where applicable. Do not send items back without receiving written authorization from us first. Unauthorized returns will not be accepted.

Return Shipping Costs: All return shipping costs are the sole responsibility of the customer. Bagulia does not cover return postage, customs fees, or any other charges associated with the return shipment. We strongly recommend using a tracked and insured shipping service, as we cannot be held responsible for items lost or damaged during return transit.

Refunds: Once your return is received and inspected, we will notify you of the outcome within 5 business days. If approved, your refund will be processed to your original payment method within 7–10 business days. Please note:

  • Original shipping costs are non-refundable
  • If you received complimentary shipping, the actual shipping cost incurred by Bagulia may be deducted from your refund
  • Bagulia reserves the right to reject or reduce refunds for items returned in a condition that differs from how they were originally sent

Exchanges: To ensure you receive your desired item as quickly as possible, we do not process direct exchanges. Please return the original item following the process above and place a new order separately.


6. Warranty

Bagulia Craftsmanship Guarantee: We stand behind the quality of every product we sell. In place of a standard warranty, we offer our exclusive Bagulia Lifetime Craftsmanship Guarantee, which includes:

  • one-time full replacement promise for manufacturing defects confirmed by our team
  • Access to our Timeless Care VIP Plan for ongoing product support

Please note that the warranty does not cover:

  • Damage caused by misuse, negligence, or accidents
  • Normal wear and tear
  • Damage caused by improper cleaning or storage
  • Modifications made by third parties

7. Intellectual Property

All content on bagulia.com, including but not limited to product images, descriptions, logos, branding, graphics, and text, is the exclusive intellectual property of Bagulia and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or use any of our content without prior written permission from Bagulia. Unauthorized use of our intellectual property may result in legal action.


8. Limitation of Liability

Liability Cap: To the fullest extent permitted by applicable law, Bagulia's total liability to you for any claim arising from or related to your purchase shall not exceed the purchase price of the product in question.

Exclusion of Indirect Damages: Bagulia shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or reputational harm, arising from the use or inability to use our products or services.

EU Consumer Rights: Nothing in these Terms limits or excludes any rights you may have under applicable EU or local consumer protection laws. If you are an EU consumer, your statutory rights remain fully intact and are not affected by these Terms.


9. Force Majeure

Bagulia shall not be held liable for any delay or failure to fulfill our obligations under these Terms where such delay or failure arises from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, floods, or fires
  • Pandemics or public health emergencies
  • War, civil unrest, or government restrictions
  • Carrier or postal service disruptions
  • Strikes or labor disputes
  • Cyberattacks or system failures

In such events, we will notify you as soon as reasonably possible and work to resolve the situation promptly.


10. Fraud & Chargebacks

We take fraud seriously and actively monitor all transactions. Customers are strongly encouraged to contact us at support@bagulia.com before initiating any chargeback or payment dispute with their bank or payment provider. We are committed to resolving all issues fairly and promptly.

Fraudulent chargebacks or disputes filed without prior communication with Bagulia may result in:

  • Permanent suspension of your account
  • Recovery of the disputed amount through legal means
  • Reporting to relevant fraud prevention agencies

11. Dispute Resolution

Good-Faith Negotiation: In the event of any dispute arising from these Terms or your purchase, both parties agree to first attempt resolution through good-faith negotiation for a minimum period of 30 days before pursuing any legal action.

12. Governing Law

These Terms of Sale are governed by and construed in accordance with the laws of Poland. Any disputes that cannot be resolved through negotiation will be subject to the exclusive jurisdiction of the Polish courts.

EU Consumer Rights: If you are a consumer residing within the European Union, you retain all rights granted to you under the consumer protection laws of your country of residence. Nothing in these Terms shall limit or override those rights.


13. Privacy Policy

By placing an order on bagulia.com, you agree to our Privacy Policy, which governs how we collect, store, and use your personal data. We are committed to protecting your privacy and handling your data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
